1.GENERAL PROVISIONS
- Persons entering the game are required to read the rules, and participation in the game constitutes acceptance of them.
- During the game, participants are obliged to follow these rules and staff recommendations.
- In the event of non-compliance with the regulations, a Fun4Brain employee has the right to ask the Player to leave the company’s premises, without the right to a refund.
- Fun4Brain reserves the right to refuse customers the opportunity to play without giving a reason.
- Smoking cigarettes, e-cigarettes, and similar devices, as well as consuming alcohol and other substances, is strictly prohibited within the company’s premises. Persons under the influence of these substances may be asked to leave the premises by staff and are required to pay for the game.
- The premises are monitored and the image and sound are recorded.
- If a group participating in the game causes damage that prevents subsequent groups from playing, they are obliged to cover the financial losses of Fun4Brain resulting from the cancellation of the reservation of the registered groups or the exclusion of the room from the offer until the defects are removed.
- Participants are responsible for the equipment in the venue and rooms during the game. In the event of damage caused by their behavior, they are obligated to cover the cost of repairs according to an individual quote or purchase new equipment. Should it be difficult to obtain compensation from the perpetrator, Fun4Brain reserves the right to request reimbursement of the cost of the equipment/repairs from the person who booked the game date.
- Fun4Brain is not responsible for the consequences of careless behavior and non-compliance with the rules by game participants, in particular behavior that may endanger the health or property of third parties.
- Game price promotions cannot be combined.
- Persons staying on Fun4Brain’s premises undertake not to hinder or disturb other people while playing.
- In matters not regulated by these regulations, the provisions of the Civil Code shall apply.
2.GAME TERMS AND CONDITIONS
- The game can be played by 2 to 5 people, or 2 to 4 people in the “Green Mile” room. Participation with one additional person is possible at your own risk and for an additional fee. Players understand that an additional number of people may result in a decrease in the quality of the game and a poorer experience of the room.
- The game master has no obligation to extend the game time.
- The minimum age for players is 13. Players under 18 may only participate in the game in the presence of at least one person over 18 years of age who is also responsible for them.
- The game is monitored, and participants consent to their participation being recorded (audio and video). In the event of any ambiguities, we reserve the right to forward the surveillance footage to Lockme to verify the accuracy of comments posted on Lockme.pl, as well as to other appropriate institutions for clarification.
- If players are late for their booked time, they may have their game shortened or their reservation cancelled without a refund (if they paid for the game in advance).
- In the event of a game being cancelled/not played due to the players’ fault, the game fee must be paid.
- Reservations can be canceled or postponed, but no later than 24 hours before the scheduled game date. Otherwise, the person making the reservation is obligated to pay for the game according to the current price list.
- If the reservation is made less than 24 hours before the game, the reservation can be canceled/postponed up to one hour after the reservation is made. Otherwise, the person making the reservation is obligated to pay for the game according to the applicable price list.
- The game is not recommended for people suffering from claustrophobia (Funeral Home/The Green Mile), epilepsy (Grandpa’s Secret/Funeral Home/The Green Mile), arachnophobia (Grandpa’s Secret), mobility limitations (Funeral Home/The Green Mile) and for pregnant women (Funeral Home/The Green Mile).
- The use of audio or video recording devices, including cell phones, is prohibited during gameplay. In the event of a violation of this rule, staff members have the right to ask the user to leave the room or interrupt the entire group’s game. Any photos or videos taken by the group in the room must be permanently deleted under the supervision of a Fun4Brain employee.
- During the game, it is prohibited to use excessive physical force and to climb on or move equipment.
- There are sharp elements in the rooms, so please be extra careful when touching them.
- All our rooms are cleaned regularly, however, due to the specific nature of the place in which they are located, there is a possibility of encountering a real spider, which is beyond our control.
- In the “Green Mile” room, certified START 1 or Major Eagle 2.5″ stun guns are used, which emit a loud sound.
3.VOUCHERS
- The voucher entitles you to participate in one game in a selected room for a group of 2-4 people or 2-5 people (depending on the room)
- You can purchase a voucher (game ticket) at www.fun4brain.pl, in person at our office, or by email at kontakt@fun4brain.pl. In the latter case, we will send you our bank account number, and once your payment has been received, we will send the voucher via email.
- The voucher is valid for 2 months from the date of purchase.
- The person who has received the Voucher and would like to redeem it should make a reservation for the game of their choice via the website, by phone at 666 319 410 or in person at the company’s office.
- It is not possible to return the Voucher.
- People who have received a voucher cannot exchange its value for cash.
4.PERSONAL DATA PROTECTION
- The controller of personal data within the meaning of the personal data protection regulations is Mateusz Marciniec, ul. Lechicka 59, 61-695 Poznań, NIP 6653007513
- The purposes, legal basis and period of personal data processing are indicated separately for each data processing purpose (see the provisions below for a detailed description of the various data processing purposes).
- Due to the personal data we process, you have the right to:
– request access to your personal data, rectification, erasure, restriction of processing, or objection to processing,
– data portability,
– the right to withdraw consent to the processing of personal data for a specific purpose, if previously consented to,
- The above rights can be exercised in accordance with the principles described in Articles 16 – 21 of the GDPR by contacting the Service Provider at: kontakt@fun4brain.pl
- Providing personal data is voluntary, but necessary in order to book a game by e-mail, telephone, at the company’s office or via the booking form on the website www.fun4brain.pl.
- The Service Provider guarantees the confidentiality of all personal data provided to it and ensures that all security and personal data protection measures required by the provisions on personal data protection are taken.
- The personal data referred to in point 5 include the name, surname, email address and telephone number of the person for whom the reservation is made.
- The legal basis for processing the User’s personal data provided in the booking form is the performance of the contract. By concluding a contract for the provision of the Service – conducting an escape room game – the Service Provider may process the User’s data to the extent necessary to fulfill this contract. The data provided in the booking form will be saved in a database and stored there until the statute of limitations for claims arising from the concluded contract expires.
- Invoices. If the Service Provider issues an invoice, it processes the User’s personal data for this purpose to the extent necessary to issue the invoice. The legal basis for data processing in this case is the fulfillment of the legal obligation to issue an invoice. Furthermore, all issued invoices are included in accounting records, and therefore, User data will naturally be processed within this documentation for the period required by law.
- Email Contact. When contacting the Service Provider via email or an order form, the User naturally provides their email address as the sender’s address. Furthermore, the User may also include other personal data in the message. The legal basis for the processing of personal data in such cases is the User’s consent resulting from initiating contact with us.
